Families of constables murdered in Wieambilla take legal action against NSW, Queensland police

The families of slain police officers Rachel McCrow and Matthew Arnold are launching legal action against NSW and Queensland police, arguing that negligence led to their deaths.

Constables McCrow, 29 and Arnold, 26, were ambushed and murdered by a trio of deluded conspiracy theorists in Wieambilla in 2022.

An inquest last month found Gareth, Nathaniel and Stacey Train were ”psychotically unwell” with a “shared delusional disorder”, but not terrorists.

The inquest also handed down 10 recommendations, including a review of the State Intelligence Group, QPS drone capabilities in remote locations, and issues of information sharing between law enforcement agencies.

The families claim negligence by the NSW Police Force and Queensland Police Service ultimately led to the constables being dropped into a firefight they had no chance of surviving.

“They believe that pertinent evidence was overlooked and not fully considered,” a statement from the families’ lawyer reads.

“Our clients are confident that, but for the alleged negligence of the NSW Police Force and the Queensland Police Service, Constable Rachel McCrow and Constable Matthew Arnold would still be alive.”

They also want to ensure that the families of other police officers “never have to suffer the kind of pain and loss that they now endure”.

Both families have lodged separate claims in the Supreme Court in Brisbane.
